Welcome to CatStats.AI (“CatStats”, “we”, “our”, or “us”) — a software-as-a-service (SaaS) reporting and analytics platform developed, owned, and operated by Witanalytica S.R.L. and RocketChair S.R.L. (together referred to as the “Company”). These Terms and Conditions (“Terms”) govern your access to and use of the CatStats.AI platform and related services (the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Definitions

1.1 Service: The SaaS platform that collects and analyzes data from tracking platforms to provide reporting and analytics.

1.2 User: Any individual or entity that accesses or uses the Service.

1.3 Trial Period: The limited-time access granted to users to evaluate the Service before purchasing a subscription.

2. Trial Terms

2.1 The Company may offer a free or paid trial period at its discretion. The duration and features available during the trial will be determined by the Company.

2.2 Users may only use the trial for evaluation purposes and must not attempt to copy, decompile, reverse-engineer, or replicate any part of the Service.

2.3 Any attempt to replicate, reproduce, or implement the functionalities, methodologies, or intellectual property of the Service within your own company or a third-party organization is strictly prohibited and will be considered a conflict of interest and a violation of these Terms.

2.4 If the Company determines that a user has violated this provision, the Company reserves the right to terminate access immediately and take legal action to protect its intellectual property rights.

3. User Obligations

3.1 You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

3.2 You shall not misuse, abuse, or attempt to interfere with the integrity or performance of the Service.

3.3 You are responsible for maintaining the confidentiality and security of your access credentials. You must not share your login information or permit unauthorized users to access the Service.

The CatStats platform includes optional two-factor authentication (2FA) and does not charge per user, enabling you to provide secure, individual access to each team member. Any data breach, unauthorized access, or data loss resulting from shared credentials, failure to enable 2FA, or failure to assign separate user credentials shall be solely your responsibility. CatStats shall not be liable for any damages arising from such incidents.

4. Intellectual Property Rights & Usage Limitations

4.1 The Service, including but not limited to its design, features, underlying algorithms, and data processing methodologies, is the exclusive intellectual property of the Company.

4.2 No part of the Service may be copied, modified, distributed, reproduced, or reverse-engineered without explicit written consent from the Company. Reverse engineering, attempting to deconstruct or replicate the Service, or any of its functionalities is strictly prohibited.

4.3 This Service is offered as a license. The subscription does not grant users any intellectual property rights over the Service.

4.4 Any feedback, suggestions, or contributions provided by users are given voluntarily. Users acknowledge that they have no claim or expectation of compensation, ownership, or future rights regarding the implementation of their feedback into the Service.

4.5 The Company reserves the right to use customer data beyond the current scope and functionality of the Service, strictly for the purpose of developing new features, improvements, and add-ons that enhance the platform experience. This internal usage is solely intended to benefit users by enabling better performance, intelligence, and automation across future versions of the product. We do not, and will never, sell, rent, or provide customer data to any third party under any circumstances.

5. Data Usage and Privacy

5.1 The Company collects and processes data as described in its Privacy Policy.

5.2 By using the Service, you consent to the collection and processing of data in accordance with the Privacy Policy.

5.3 For customers on the Free Tier, the Company may use aggregated and anonymized data to compile industry-wide reports and benchmarks related to affiliate marketing. This helps us offset infrastructure and processing costs, allowing us to continue offering meaningful insights to non-paying users. We take extensive precautions to ensure that no individual company or customer can ever be identified. Aggregated data is only included in such reports when the sample size is large enough to protect anonymity and prevent reverse-engineering of individual performance — in plain terms, we never use data where someone could guess who it belongs to. The data of customers using trial accounts is excluded from this process and will never be used for industry reporting or research.

6. Service Availability and Reliability Disclaimer

6.1 The Service is in continuous development, and we do not guarantee 100% availability or uninterrupted service.

6.2 Users are advised not to base critical business decisions solely on the data and reports generated by the Service. The Company assumes no responsibility for any business losses or damages arising from reliance on the Service.

7. Limitation of Liability

7.1 The Service is provided “as is” without warranties of any kind, whether express or implied.

7.2 The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service.

8. Termination

8.1 The Company reserves the right to terminate or suspend access to the Service at its discretion, especially in cases of a violation of these Terms.

8.2 Upon termination, all rights granted to the user under these Terms shall cease immediately.

8.3 Upon termination, the Company will delete any customer-specific data within a commercially reasonable time frame, except where retention is required by applicable law or necessary for legitimate internal purposes such as security or dispute resolution. This aspect is further detailed under our privacy policy documents. Users may also request written confirmation of data deletion, subject to verification of identity and account ownership.

9. Governing Law

9.1 These Terms shall be governed by and construed in accordance with the laws of Romania, a Member State of the European Union.

9.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Romania.

10. Changes to Terms

10.1 We reserve the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be published on the CatStats.AI website or communicated via email to registered users.

10.2 Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
